By using the Unwire application (the "App" or "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Unwire. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & Account

To use Unwire, you must:

• Be at least 13 years old (or 16 in the European Economic Area)
• Have the legal capacity to enter into binding contracts
• Comply with all applicable laws and regulations in your jurisdiction

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Access and use the App's features for personal, non-commercial purposes

This license does not include the right to:

• Modify, reverse engineer, or create derivative works
• Sell, rent, lease, or sublicense the App
• Remove or alter any proprietary notices

4. Subscriptions & Billing (EULA)

Unwire offers both free and premium features:

• Free Features: Core functionality is available at no cost
• Premium Features: Additional features may be available through in-app purchases or subscriptions

Auto-Renewable Subscriptions

Unwire offers the following auto-renewable subscription options:

• Monthly Premium: Billed monthly at the price displayed in the app
• Yearly Premium: Billed annually at the price displayed in the app

Payment & Renewal

If you purchase a subscription:

• Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage or cancel subscriptions through your device's account settings at any time
• Billing occurs through your Apple App Store or Google Play Store account
• Prices are shown in your local currency and may include applicable taxes

Cancellation & Refunds

• You may cancel your subscription at any time through your device settings
• Cancellation takes effect at the end of your current billing period
• No partial refunds are provided for unused portions of a subscription period
• Refunds are handled according to Apple's and Google's respective refund policies

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to gain unauthorized access to the App or our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated tools (bots, scrapers) to access the App
• Impersonate any person or entity
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Collect or store other users' personal information

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

• Text, graphics, logos, icons, images
• Software code and algorithms
• Learning modules and educational content
• User interface and design elements
• Assessment tools and questionnaires

are owned by Unwire or our licensors and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any personal content you create within the App (e.g., journal entries, reflections), but grant us a license to store and process this content to provide our services.

7. User Content

When you create content within the App (such as notes, reflections, or community posts):

• You retain ownership of your content
• You grant us a license to use, store, and process your content to operate the service
• You represent that you have the right to share this content
• You agree not to post offensive, harmful, or illegal content
• We reserve the right to remove content that violates these Terms

8. Health and Medical Disclaimer

NO MEDICAL OR HEALTH ADVICE: Unwire is strictly an educational and wellness tool. It is NOT a medical device, diagnostic tool, or replacement for professional medical, psychological, or mental health services.

Limitation of Liability for Health Outcomes:

• The App does not diagnose, treat, cure, or prevent any disease, condition, or mental health disorder
• All assessments, content, tools, and recommendations are for informational and self-awareness purposes ONLY
• We provide no guarantees, warranties, or assurances regarding any health-related outcomes
• Content is based on scientific literature but is NOT professional medical advice

NO RESPONSIBILITY FOR CONSEQUENCES:

Unwire and its creators, operators, and affiliates accept NO RESPONSIBILITY OR LIABILITY for any consequences arising from use of the App, including but not limited to:

• Physical, psychological, emotional, or mental health outcomes
• Medical conditions or complications
• Relationship, professional, or personal consequences
• Financial losses or damages
• Any direct, indirect, incidental, or consequential damages of any kind

MANDATORY PROFESSIONAL CONSULTATION:

• If you have concerns about digital addiction, mental health, or any health-related issues, you MUST consult a qualified healthcare professional
• Always seek advice from a licensed medical doctor, psychiatrist, psychologist, or licensed therapist
• Never disregard professional medical advice or delay seeking it because of information from this App
• The App is not intended for use in clinical settings or for diagnostic purposes

USE AT YOUR OWN RISK: By using this App, you acknowledge and agree that you do so entirely at your own risk and that you are solely responsible for any consequences resulting from its use.

9. Disclaimers & Limitations of Liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of content

Limitation of Liability:

To the maximum extent permitted by law, Unwire and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Personal injury or property damage
• Damages arising from your use or inability to use the App

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Unwire and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activities
• Risk to the service or other users
• Extended periods of inactivity
• Any other reason at our sole discretion

You may terminate your account at any time by:

• Deleting your account through the App settings
• Contacting us at support@unwireapp.com
• Uninstalling the App (though this may not delete your account data)

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account and data in accordance with our Privacy Policy
• Certain provisions of these Terms will survive termination (e.g., indemnification, disclaimers)

12. Changes to the App and Terms

We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Update these Terms periodically
• Change pricing for premium features with advance notice

Material changes to these Terms will be communicated through:

• In-app notifications
• Email (if you provided an email address)
• Update to the "Last updated" date above

Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of your jurisdiction of residence, without regard to conflict of law principles.

For disputes arising from these Terms or your use of the App:

• You agree to first attempt to resolve disputes informally by contacting us
• If informal resolution fails, disputes may be resolved through binding arbitration or small claims court
• You waive any right to participate in class action lawsuits or class-wide arbitration

Specific dispute resolution procedures may vary by jurisdiction. Users in the European Union have the right to submit complaints to their local consumer protection authorities.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unwire regarding the App and supersede all prior agreements and understandings.

17. App Store Requirements

Apple App Store: If you downloaded the App from the Apple App Store, you acknowledge that:

• These Terms are between you and Unwire, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for any claims related to the App
• Apple is a third-party beneficiary of these Terms

Google Play Store: If you downloaded the App from Google Play, you agree to comply with Google Play's terms of service in addition to these Terms.
